We reserve the right to amend or update these Terms of Service at any given time, without prior notice to you. It is incumbent upon you to periodically review these Terms of Service for any modifications. Your continued usage of the website following the posting of any changes to these Terms of Service indicates your acceptance of said changes.
By using this website, you assert that you are of legal age and possess the capacity to enter into a binding contract. Should you fail to meet these stipulations, you are prohibited from utilizing the website.
In the event of a breach of any of these Terms of Service, we reserve the right to terminate or suspend your access to the website without prior notice.
Importantly, this agreement supersedes any and all prior written or verbal agreements made by Cody Butler / Comeback Culture or any of its agents. By agreeing to these Terms of Service, you acknowledge that this agreement overrides any other arrangements or understandings you may have had with Cody Butler / Comeback Culture or its representatives.
1. Explanation of Agreement
We thank you for your expression of confidence in hiring us to act as your Coach. It is our belief that a clear understanding between the Coach and the Client with respect to the terms of this Agreement and our fees is fundamental to a good relationship. This Agreement explains in detail our mutual expectations and obligations to each other and will provide you with a reference for any questions that might arise during our relationship.
2. Client and Coach
- In this agreement, the term ‘Coach’ refers to Cedia Media Pty Ltd doing business as Cody Butler / Comeback Culture. 
- In this agreement, the term ‘Client’ refers to any person or entity that purchases or uses the services or programs provided by Cedia Media Pty Ltd doing business as Cody Butler / Comeback Culture. 
3. Definition of Coaching
Coaching is a partnership (defined as an alliance, not a legal business partnership) between the Coach and Client, in a thought-provoking and creative process that inspires the client to access and maximize their personal potential.
4. Our Relationship
The Coach agrees to maintain the ethics and standards of behavior established by the International Coach Federation (ICF). The Client is responsible for their own well-being, decisions, choices, actions, and results arising out of or resulting from the coaching relationship. The Client understands coaching is not therapy and does not substitute for therapy, nor does it prevent, cure, or treat any mental disorder or medical disease.
5. Coaching Is Not Medical Advice
The Client acknowledges that coaching provided by Cedia Media Pty Ltd (d/b/a Cody Butler / Comeback Culture) is not a substitute for therapy, counseling, psychotherapy, or other mental health services, and is not intended to diagnose, treat, or cure any mental or emotional disorders.
6. Liability
Cedia Media Pty Ltd, doing business as Cody Butler / Comeback Culture, provides coaching services. By engaging our services, you acknowledge and agree that our advice does not constitute therapy, medical advice, or counseling. You agree that Cedia Media Pty Ltd, its directors, officers, employees, and agents shall not be liable to you or any third party for any damages arising out of or relating to any services provided. You agree to indemnify and hold harmless Cedia Media Pty Ltd, its directors, officers, employees, and agents from any and all claims, losses, or expenses (including attorneys’ fees).
7. Confidentiality
All information shared with the Coach is confidential, subject to exceptions required by law (e.g., imminent risk of harm, illegal activity, or court order). Topics may be shared anonymously with other coaching professionals for supervision or professional development.
8. Recordings
All calls may be recorded (video and audio). Recordings and related materials become the property of the Coach and may be used at their discretion. The Client will not be compensated for appearances in recorded calls.
9. Intellectual Property
The Coach retains ownership of all intellectual property rights in materials and content used within coaching or training sessions. Clients may not copy, reproduce, share, or distribute these materials.
10. Limited Liability
The Coach makes no guarantees of results. In no event shall the Coach’s liability exceed the total amount paid by the Client under this Agreement.
11. Reliance on Materials
Clients should not rely on any materials provided as legal, medical, financial, or other professional advice. The Provider disclaims all liability from reliance on such materials.
12. Force Majeure
The Provider is not liable for delays or failure to perform obligations caused by events beyond reasonable control, including natural disasters, pandemics, or government restrictions.
13. Severability
If any provision of this Agreement is held invalid, the remaining provisions shall continue in effect.
14. Waiver
Failure to enforce any provision does not constitute a waiver of the right to enforce it later.
15. Nature of Services and Payment Structure
All payment schemes offered by Cody Butler / Comeback Culture and/or any of its partners are structured as a loan or payment plan, wherein the total cost of the service is required to be paid in full. These services are not memberships or cancel-at-any-time commitments. Once the seven-day cancellation window has expired, all associated loan repayments become irrevocable, non-refundable, and non-cancellable.
16. Credit Check for Payment Plan
If a third-party payment plan provider is used, the Client may be subject to a credit check. By choosing a payment plan, the Client consents to this process.
17. Payment Plan Clarification Clause
- Nature of Payment Plans: Payment plans are solely a method of paying the full program cost over time. 
- No Memberships or Subscriptions: Payment plans do not constitute subscriptions. 
- Full Cost Commitment: By selecting a payment plan, the Client commits to paying the entire program fee in full. 
18. Applicable Law
This Agreement is governed by the laws of the Commonwealth of Australia and New South Wales.
19. Cooling Off and Cancellation
- Cooling Off Period: Clients may cancel within seven (7) days of acceptance with written notice. 
- Notification: Cancellation must be submitted in writing to support@codybutler.com (or designated email). 
- Consequences: If cancelled within the cooling-off period, all payments will be refunded within 14 days. After this period, no refunds will be issued. 
- Services Delivered: After the cooling-off period, services are deemed delivered in full. 
20. Lifetime Access Clause
“Lifetime access” means access to program content for the duration of the program’s availability. It does not mean the lifetime of the client. The Provider reserves the right to modify or discontinue programs at its discretion. Coaching services are limited to six (6) months from enrollment unless otherwise extended in writing.
21. Entire Agreement
This Agreement constitutes the entire agreement between the Coach and the Client, superseding all prior representations or agreements. No modifications are valid unless made in writing and signed by both parties.
